Sourav Ganguly gets Rs 1.5 crore service tax relief – Times of India

NEW DELHI: Cricketer Sourav Ganguly, who is currently the president of the Indian cricket board, has won a relief from the tax tribunal in a Rs 1.5-crore service tax claim. A bench of the Customs, Excise and Service Tax Appellate Tribunal in Kolkata has dismissed the service tax commissioner’s demand raised in November 2012 under business auxiliary service, support services of business or commerce, with interest and penalty.
Ganguly argued that band endorsement or promotion services were made taxable from July 1, 2010 and he had been paying tax on this account since then. But the department had raised demand from May 2006, which the former India captain questioned.
“Kolkata CESTAT held that for the period May 1, 2006 to June 30, 2010, there was no specified category under which service tax could have been levied for the activities undertaken by Mr Ganguly, thereby passing an order in his favour,” said Abhishek Jain, tax partner at EY.
The tribunal also upheld the cricketer’s claim that he should not be taxed for anchoring TV shows. A similar stance was also taken by the tribunal with relation to writing articles.
